There is a real lack of Family Law Solicitors nationally that have a Legal Aid certificate. Even if they are publicly funded, they are so busy that it can take days, even weeks to be seen and go into Court. Obviously, whilst living with an abusive partner, this is way too long for anyone to wait.
Where an individual is ineligible for public funding (for example where they are working or own their own property), there are very few options for getting legal advice and in particular Court Representation. This, in most cases, leaves people with no protection.
There is a significant shortage of Family Law Solicitors across the country who hold a Legal Aid contract. Even when public funding is available, solicitors are often so overstretched that it can take days or even weeks to obtain an appointment or access the courts. For someone living with an abusive partner, this delay is far too long.
For individuals who do not qualify for Legal Aid such as those who are employed or own property there are very limited options for accessing legal advice or securing representation in court. In many cases, this leaves people without any protection at all.
The Centre for Domestic Abuse offers a straightforward and compassionate resolution. Victims are contacted immediately, provided with all available options, and the necessary documents are prepared within 24 hours.
This allows Victims to avoid the long waits often experienced when trying to hear back from a solicitor, regardless of the individual's financial circumstances.
Time is of the essence, and CDA ensures that support is fast, accessible, and free of charge.
While police intervention can result in arrests and criminal charges, many victims understandably hesitate to take this route. For some, there is a deep fear that involving the police may provoke further violence or retaliation from the abuser, putting themselves or their children at even greater risk.
For others, emotional ties, hope for change, or a long history of coercive control can make the thought of taking legal action against a partner feel overwhelming or even impossible. Feelings of shame, guilt, or isolation may also prevent individuals from seeking help through the criminal justice system.
These complex emotional and psychological barriers are real and valid, and they often leave Victims feeling trapped and unsure of where to turn.
There are alternative legal protections available under the Family Law Act 1996, which allow victims of domestic abuse to seek safety through the civil courts. These remedies include:
● Non-Molestation Orders
● Occupation Orders
Unlike criminal proceedings, these civil orders rely on a lower standard of proof, making them more accessible and often quicker to obtain. They provide a vital legal safeguard for those who need protection but may feel unable—or unwilling—to go through the criminal justice system.
